These Terms of Service (the "Terms") are an agreement between you and Cascadia Applications LLC, an Oregon limited liability company ("we," "us"), the operator of Bit Builder (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
Bit Builder is a workbench for writing, organizing, rehearsing, and recording performed material. We may add, change, or remove features over time; if a change materially reduces the Service, the remedy in Section 10 applies.
You must be at least 13 years old. Provide accurate account information and keep your credentials secure — activity under your account is your responsibility. Guest sessions are offered as a trial convenience and their data is deleted after a period of inactivity if never registered.
You own the material you create in the Service — every joke, bit, set, note, idea, and recording ("Your Content"). You grant us only the limited license needed to operate the Service: to host, store, back up, transmit, and display Your Content to you and to those you share it with, and to process it at your direction (for example, transcribing a recording when you ask). This license ends when the content or your account is deleted, except for routine backup cycles. We claim no ownership of Your Content, we do not use it to train AI models, and we do not share it with advertisers.
You agree not to:
Some features let you share with others — accountability groups, and in products in this family, shared workspaces. Content you place in a shared space is visible to its members. You are responsible for what you share and for only inviting people you intend to give access. Owners of shared spaces can manage membership; leaving or removal ends access going forward, and work contributed to a shared space remains with that space, as the feature describes.
Some features require a paid subscription ("Pro"). On iOS, Pro is billed through your Apple account and renews automatically until you cancel in your device's subscription settings; Apple's refund policies apply. Where we offer subscriptions on the web, they are billed by our payment provider and can be canceled from the billing portal, effective at the end of the current period. Prices may change prospectively with notice; a change never applies retroactively to a period you've already paid for. Free features may be changed without notice, and free trials convert to paid unless canceled before the trial ends.
We aim to keep the Service available and your data safe: encrypted transport, routine backups, and an export you can run yourself at any time (Account menu → "Export data"). Still, no service is uninterruptible, and you should keep your own copies of material you cannot afford to lose. Recordings are large; keep originals of takes that matter to you.
You can stop using the Service and delete your account at any time from within the app, which deletes Your Content per the Privacy Policy. We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users; unless the violation prevents it, we will give you a reasonable opportunity to export Your Content first.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from or related to the Service. Our total liability for all claims in any twelve-month period will not exceed the greater of the amounts you paid us for the Service in that period or fifty dollars ($50). Some jurisdictions do not allow certain limitations; where a limitation is not permitted, it applies to the maximum extent permitted.
We may update these Terms. For material changes we will notify you in the app or by email, and the "Last updated" date will change. Continued use after a change takes effect constitutes acceptance; if you don't agree, stop using the Service and delete your account.
These Terms are governed by Oregon law, without regard to conflicts principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Oregon, and you consent to their jurisdiction. Either party may seek relief in small-claims court for qualifying disputes.
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remain in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the business. Our failure to enforce a provision is not a waiver.
